MUNICIPAL CLEARANCE FIGURES & CERTIFICATES
WHEN SELLING/TRANSFERRING A PROPERTY:
Municipality/Deeds Office Requirements in terms of Section 118 of the Local Government Municipal Systems Act No. 32 of 2000:
Legislation, the Deeds Office and the Municipality requires a Municipal Clearance Certificate in order to pass transfer of a property.
A "Clearance Certificate" is obtained after the Municipality receives payment of the amounts they certify are owed to them for Rates, Taxes, Water, Electricity etc.
This Certificate however is only in terms of Section 118 i.e. for the last 2 years charges.
(Please note this does not mean that amounts prior to the 2 year period are "Written Off". We will settle these amounts for you as well, if appliacable)
The Municipality/Deeds Office also require that the Certificate be valid for an extended period of time. The Municipality includes these charges in their Clearance Figures.
- The Seller is normally liable for all the above charges until Transfer. Thereafter the Purchaser is liable.
The Clearance figures are normally obtained by the Transferring Attorney.
